You may wonder where abortion access stands in the state of Ohio after the overturning of Roe v. Wade. It can be a confusing time for many, but you are not alone.

If you live in Ohio and are thinking about getting an abortion, here is what to know about abortion laws in your state.

The Overturning of Roe v. Wade Explained

The overturning of Roe surprised many as abortion had been widely protected as a constitutional right for many years since the Supreme Court ruling in 1973.

June 2022 changed everything as the law that the Supreme Court once ruled as a constitutional right for women was overturned. Now the states have the power to decide if abortion is legal or not and can put certain restrictions in place for their state or not.

Is Abortion Legal in Ohio?

In Ohio, the heartbeat bill was implemented right after the overturning of Roe v. Wade. This heartbeat bill prohibits abortion if a fetal heartbeat is detected, usually around six weeks of gestation.

Since this bill became law, a judge indefinitely blocked the state’s ban on abortion after six weeks of pregnancy, and a lawsuit against it continues. Abortion is still legal in Ohio, but only up until 22 weeks of pregnancy.

Ectopic Pregnancy & Miscarriage

After the overturning of Roe v. Wade was announced, many women feared there were restrictions for ectopic pregnancy treatment or miscarriage treatment, but this is not true. It’s important to make clear that both of these medical procedures are not the same as an abortion procedure.

Abortion is a procedure chosen by a woman that terminates an existing, viable pregnancy. Both an ectopic pregnancy and miscarriage occur naturally, not by choice, and are treated to remove a non-viable pregnancy. Each of these complications are legally treated, as both can cause ill health effects to women if not addressed right away.
